Conveyance of Messuage Cottage or tenement outbuildings yard garden and premises situate in Philcock Street Deddington in the County of Oxford

This Indenture made the twenty seventh day of December One thousand nine hundred and one
Between Mary Ann Malins of 71 High Street Stony Stratford in the County of Bucks Spinster
Margaret Ann the wife of Thomas Arton Slatter of “Fairview” Hales Street Winchcombe in the County of Gloucester
and Jane Key of 70 Stanley Road Bedford in the County of Bedford Widow of the one part

The Reverend Thomas Boniface of Deddington in the County of Oxford Clerk in Holy Orders
Charles Bennett of the same place Farmer and Builder
George Coggins of the same place Solicitor
Bryan Worsley Millington of the same place Farmer
Henry Moullis of the same place Saddler and Harness Maker
Holford Cotton Risley of the same place Esquire
and John Spiers of the same place Carpenter
being the Co-operative Trustees of the Deddington Town Lands Charity

being the Representative Trustees of the Deddington Town Lands Charity the whole of such Trustees being herein after referred to as the Feoffees of the second part
and Samuel Gibbs of Aynho in the County of Northampton Bootmaker of the third part

Whereas by an indenture dated the twentieth day of November One thousand eight hundered and thirty seven (20th Nov 1837) and made between the said John Malins of the one part and Catherine Field of the other part the herditaments hereinafter described were demised unto the said Catherine Field her executors administrators and assigns for the term on payment by the said John Malins to the said Catherine Field of the sum of One hundred and forty pounds (£140) with interest thereon on a day now past

And Whereas by Indenture dated the first day of October One thousand eight hundred and forty four (1st Oct 1844) made between the said Catherine Field of the first part and the said John Malins of the second part and

the surviving Trustees of the Feoffees of certain Charity estates moneys funds and premises given to Charitable uses in the parish of Deddington aforesaid of the third part for the consideration therein mentioned the said Catherine Field assigned and the said John Malins granted confirmed unto the said

and their successors the hereditaments therein and hereinafter mentioned and described

To hold the same unto and to the use of the said

and their successors for and during all the residue and remainder then to come and unexpired of the said term of one thousand years subject to the proviso for redemption on payment by the said John Malins of the principal sum of One hundred and forty pounds (£140) and interest as therein mentioned

And Whereas the said John Malins duly made his Will dated the tenth day of May One thousand eight hundred and eighty (10th May 1880) and thereby appointed his daughters the said Mary Ann Malins, Sophia Malins, the said Margaret Ann Slatter, and the said Jane Key to be the Trustees and Executors of his said Will and the said testator devised (inter alia) the said hereditaments and premises hereinafter more particularly described and all other his real and personal estate whatsoever and wheresoever unto and to the use of his said Trustees Upon trust when and as soon as they in their absolute discretion should deem expedient after his decease sell and convert the same into money as therein mentioned

And Whereas the said Testator John Malins died on the ninth day of October One thousand eight hundred and eighty eight (9th October 1888) without having altered or revoked his said Will and the same was duly proved by all the said Executors on the ninth day of November One thousand eight hundred and eighty eight (9th November 1888) in the Principal Registry of Her Majestys High Court of Justice

And Whereas the said Sophia Malins died on the second day of May One thousand eight hundred and ninety four (2nd May 1894)

And Whereas the said Feoffees are the successors in office of the said

And Whereas in exercise of the trust for that purpose contained in the said Will the said Mary Ann Malins Margaret Ann Slatter and Jane Key, have agreed to sell the hereditaments and premises hereinafter described to the said Samuel Gibbs at the price of One hundred and thirty pounds

And Whereas the said sum of One hundred and forty pounds remains owing on the security of the hereinafter recited Indenture of Mortgage and Transfer thereof but all interest for the same has been paid up to the date of these presents

And Whereas upon the treaty for the said purchase it was agreed that the said sum of One hundred and thirty pounds purchase money should be paid to the said Feoffees together with Ten pounds from other estate of the said John Malins deceased

Now this Indenture witnesseth that in consideration of the sum of One hundred and thirty pounds (£130) to the said Feoffees paid by the said Samuel Gibbs on or before the execution of these presents by the direction of the said Mary Ann Malins, Margaret Ann Slatter and Jane Key and the sum of Ten pounds (£10) to the said Feoffees at the same time paid by the said Mary Ann Malins, Margaret Ann Slatter and Jane Key, making together the sum of One hundred and forty pounds (£140) (the receipt whereof the said Feoffees hereby acknowledge) the said Mary Ann Malins, Margaret Ann Slatter and Jane Key, as Trustees hereby convey and the said Feoffees as Mortgagees by the direction of the said Mary Ann Malins, Margaret Ann Slatter and Jane Key, and to the intent that the said term of One thousand years created by the hereinbefore recited Indenture of the twentieth day of November One thousand eight hundred and thirty seven (20th November 1837) may be merged and extinguished into the freehold and inheritance thereof hereby surrender unto the said Samuel Gibbs

All that messuage cottage or tenement situate standing and being in Deddington aforesaid in a certain Street there called or known by the name of Philcock Street with the outbuildings yard garden and appurtenances to the same adjoining and belonging formerly for many years in the occupation of John Malins since of George Morse and now of John Calcutt

To hold the same unto and to the use of the said Samuel Gibbs in fee simple freed and discharged from all principal money and interest secured by and all claims and demands under the said Indenture of Mortgage and Transfer thereof

In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written
